Thank you for choosing to use "Sneeze-O-Rama" ("the App"), using the App is conditioned upon your agreement to the following Terms of Use ("the Terms"). Please take a moment to read the Terms. By using the App you declare that the Terms are acceptable to you.
The App is owned and operated by InTent Systems Ltd., a company incorporated under the laws of the State of Israel ("The Company"). The App is operated in accordance with the law of the State of Israel. If you access the App and use it from outside the State of Israel you do so on your own initiative and at your own discretion, and in such a case you are the sole responsible for adhering to the local laws applicable to you.
The App is designed to be a humoristic game which enables you to record vocal sounds that the App then identifies as real or fake sneezes, or other undefined sounds. The App provides certain information about the user deriving from their recordings. This information is not considered, and should not be regarded, as professional diagnosis, psychological, psychiatric, medical or any other form of professional consulting.
The App allows users to keep scores. It should be noted that the App is not a gambling App, nor does it encourage gambling in any way.
The App enables users to chat with other users, on an anonymous basis. Users should refrain from using their real names when using the App and take acceptable precautions when chatting with other users.
Use of the App is not age restricted, but it is advised that minors use the App under parental supervision.
Use of the App is free of charge. However, external payments may be associated, such as Internet connection suppliers and additional services. You are responsible for all external payments.
The appearance of the App may change, including, but not limited to, adding or removing of buttons and options, rearranging the order of appearance etc.
It may occur that the use of the App will be interrupted, due to scheduled maintenance or due to current debugging procedures. Interruptions in use may also be caused as a result of bugs, loss of internet connection or specific problems with the user's device. In any case the user shall have no claim or suit against the Company on the grounds of damages suffered by such interruptions.
The Company may, at its own discretion and without prior notice, block access to the App from users who abuse it. You may, at any time, terminate your account with the App and remove it from your device.
By using the App you declare that you have all the information required for using the App. The access and use of the App is restricted to legal and acceptable purposes only. You hereby undertake not to perform any of the following:
The Company is not in control of how users use the App, and it shall not be liable for any action performed by the users of the App. The Company does not monitor the content of messages sent via the App's chat, and cannot prevent in advance the misuse of the chat for inappropriate or illegal purposes. If users encounter malicious behavior in the App's chat they are advised to report the matter to the Company, as well as to law enforcement authorities.
The App collaborates with sponsors, and may further partner with external service providers and affiliated companies. Ads are incorporated in the App and may appear from time to time during the use of the App. The Company does not control the content of the ads and is not responsible for their suitability for the users. The ads are provided through AdMob and in accordance with their terms and references.
The Company is the sole holder of any intellectual property rights, including the copyrights, of the App and all the content included therein.
Providing personal information on the App is done at the free will of the user and subject to your full consent. By using the App you are aware and agree that certain data is collected about you and that this data may be used by the Company as specified herein.
Information on users is gathered when the user fills in details in the App, when the user uses the App, and when the user allows the App to access their device's microphone and speakers. This information is gathered in order to improve user experience of the App, and may include such information as user's location, voice recordings, user's nickname and any information associated with that nickname's activity in the App etc. The information is not collected on the user's personal identity. Be advised that the information gathered about you will be maintained by the Company for however period of time as the Company may decide, even after you have terminated your account with the App.
The Company is neither responsible, nor aware of any other entity collecting data on users while using the App, though this may occur without the knowledge of the Company. The Company is making reasonable efforts to preserve the privacy of the users. However, the Company cannot promise an absolute protection from malicious penetration to its accounts.
The Terms may be amended from time to time, please check the Terms from time to time to catch up on any modifications that may have been inserted.
The Terms are written in the English language. Any translated version is an unofficial one and does not represent the Company or the App. The English version shall prevail over any translated version.
Any dispute arising out of the Terms, their application or interpretation, or in any connection to your use of the App, will be settled amicably by the parties. The jurisdiction to hear such disputes is hereby granted exclusively to the courts in Tel-Aviv Yafo district, Israel.
